Two forestry workers refused to take a giant tree cutting Harvester down a ravine because they believed they could be killed. They also feared others working around the huge machine would be in danger. As a result they were bullied and harassed out of their jobs. The forestry industry is notorious for their cavalier behaviour to workers safety. Many are killed or maimed. Bosses are not held accountable.
ORDERED TO PUT LIFE AT RISK
In January this year Hans* and another worker were told by management to drive their Harvester down a steep ravine. We understand this dangerous instruction was to save time and allow the company to keep to their timeline. The workers refused.
They formally raised a complaint about the safety breaches with the employer ATS Logging Limited based in the Hawke’s Bay. The directors are a husband and wife team Amy Satherley and Toby Satherley. Nothing came from the raising their concerns. Instead the workers were subjected to a bullying campaign where unreasonable and contradictory demands were constantly made. They claim they were then harassed for not achieving them. One of the workers resigned claiming he could no longer put up with this abuse. The remaining worker, Hans* is German and his visa was linked to the employer, so it wasn’t so easy to leave.
YOU CAN LEAVE
Hans requested a meeting to formally complain about the ongoing harassment campaign, and that he was publicly taunted by being publicly referred to as “Adolf Hitler”. To call someone whose family was a victim of Nazism, is sickening. It was deliberately used as a racist and hateful slur to humiliate Hans. The director Amy Satherley, the chief harasser and another manager attended the meeting. Amy told Hans that if he didn’t like working there “he could leave”.
After this meeting the campaign against Hans intensified. Hans was constantly derided in front of others. He was constantly mocked as Hitler and being a Nazi on the employers open CB public system. The Satherleys were on the system and heard the abuse and did nothing. Hans repeated request for this name-calling to stop only intensified this behaviour.
After a month, Hans broke down and saw a doctor. The doctor diagnosed Hans as suffering from profound physiological and psychological stress caused by his work environment. The doctor issued a medical certificate for seven days leave. A week later the doctor was even more concerned and issued a certificate for a further three weeks leave. Both certificates were emailed to the employer.
BOSS GETS REALLY NASTY
Toby Satherley phoned Hans at home accusing him of lying about his illness. Toby said he’d heard Hans was unhappy at the job and wanted to leave. Toby said he was “going to talk to very forestry owner from Hawkes Bay to Taupo to Rotorua” and that “the companies down here know each other well and once I talk to them about you, you will never get a job again”. Hans’s partner quick-witted action to record Toby abusing Hans will become exhibit A should we have to present it as legal evidence of their bullying behaviour.
Hans then reached out to us. When my colleague contacted Amy, she refused to engage other than demand the return of the company car that Hans had a part of his employment agreement. Despite receiving both medical certificates the employer claimed that Hans never advised them he was unwell, or that it was the result of his mistreatment at work.
My colleague was bemused when she starting threatening him. After that call ended, she sent a Repo man to take the car from Hans’s property. This action gives me an insight into the character of the Satherleys.
When I met Hans it was clear he was still in a state of trauma. We gave the Satherleys the chance to just apologise and do the right thing by Hans. Unfortunately like all bullies, they won’t. Instead they think if they brazenly ignore us, we will go away. We won’t.
CALL FOR JUSTICE
We filed a personal grievance against the Satherleys this week, claiming unfair dismissal seeking an apology and compensation for Hans. We have heard nothing back as yet.
I’m tired of nasty bullies in positions of power callously destroying vulnerable people’s lives. I hope you are too.
