Last night the Supreme Court of NSW ruled that due to COVID-19 public health orders, any gathering of crowds as part of the protest would be illegal.

Sydney's 'Black Lives Matter' protest has been deemed a legal assembly of people just moments before the rally officially started on the steps of the city's town hall.

The organisers of the rally took the decision to the NSW Court of Appeal, who overturned the Supreme Court's decision and declared the demonstration an "authorised public assembly".

News of the decision was read aloud to thousands of protestors, eliciting a huge cheer from the crowd.

Despite the rally being deemed legal, organisers were still urging protesters to practise social distancing, wear masks and travel in groups of 10 or less.

The decision means protesters cannot be arrested for blocking roads along the planned route from Town Hall to Belmore Park.

Town Hall station in Sydney's CBD will be closed between 2pm and 4pm due to the Black Lives Matter protest.

Trains in the city will continue to operate, but none will be stopping at Town Hall station.

More than 5000 demonstrators are expected to attend.
